WOBO Governor David Gibson appreciates the update provided by LABC.
Last week the Department of Levelling Up, Housing and Communities (DLUHC) issued eight drafts of secondary legislation likely to accompany the Building Safety Bill. These cover all the main areas of the proposed legislation and of particular interest to building control are:
- Restricted activities and functions
- Building safety fees
- Building control procedures for HRBs
These are currently in draft form and LABC is continuing to press government for changes as it is clear some of the proposals are not yet fully developed. The DLUHC is committed to consulting on the secondary legislation and LABC will consult with our members through the Management Services Working Group at that time. But in the meantime, please send any comments on the secondary legislation to info@labc.co.uk
In addition, the Department has also published 29 factsheets covering all the key aspects of the new regime. This includes factsheets on:
- Buildings in Occupation – covering building registration, transitional arrangements for the Building Assessment Certificate, refurbishment and the Safety Case
- Wider changes to the Building Act 1984
- Industry competence
- Building Safety Regulator and building control regime (Gateways 2 and 3)
Similarly, the HSE has also published 4 factsheets providing guidance about their early position on the regulatory approach of the Building Safety Regulator, covering the regulator’s approach to cost recovery, regulating risk in occupied HRBs, new and refurbished HRBs and their approach to enforcement.
